Date set for trial over troubled acquisition.
A jury trial date of April 6, 2010 has been set for the lawsuit between Thought Convergence and Jay Westerdal et al.
Thought Convergence (TCI) filed the lawsuit against Westerdal on May 1 over TCI’s purchase of Westerdal’s company Name Intelligence. Name Intelligence is best known for its DomainTools web site, but it also owns web hosting company Spry. In the suit, TCI claimed alleged breach of securities exchange agreement, breach of employment and non-compete agreements, breach of fiduciary duty, breach of covenant of good faith and fair dealing, and accounting.
Westerdal responded with a number of counterclaims, alleging a “Myriad of deliberate misrepresentations made by TCI during the negotiation process and execution of the agreement.”
Both parties have denied each others’ allegations.
The discovery cut-off is February 16, 2010 and the final pre-trial conference is scheduled for March 8, 2010. It’s rare that a case like this actually makes it to trial; it is likely the case will be settled before then.

As you will recall from my last posting on October 20th, I was hired by the Central Wisconsin Educators Board of Directors to build a new Website.

The CWE approved my project scope and signed off on the project. Apparently the council was very impressed with my scope document and was thoroughly delighted with the budget section where their internship savings were written up. Who doesn’t like to save money these days right!
I spent roughly 15 hours this week(end) building out the rough draft of the site. This was roughly 15% more time than I budgeted for and is my first good learning lesson. In the future, I will likely estimate more liberally when it comes to development time.
Thus far, I have created the following pages:
Home : The primary content of this page still needs to be added. The CWE has not printed their 2010 Convention handbook yet in which I planed to pull content from to populate this page. I have also asked the Board of Directors if anyone was willing to write content for this page specifically asking them, “who is the CWE and what is to be expected from the 2010 convention.”
Executive Committee : This page lists the current Executive Committee for the CWE along with their contact information. This page was pretty straightforward, implementing the 3 column design using CSS wasn’t too tricky and caused me no problems.
Sectionals & Topics : This page will eventually house a list of the current year’s convention sectionals and topics. I have the page set up with a table that I will populate once the information is available. I have also provided a link to the current year’s convention booklet in pdf form, which I will upload once it is available.
Ticket & Location Information : This page lists the current admission information for the event. It also has an embedded map with a link for directions for event visitors. Implementing the map was really easy as the code was supplied by MapQuest. I created a couple of div containers to put the map into and put a nice border on them for cosmetics. I like how the map is dynamic within my page and can be zoomed/panned without leaving the site, much better than a static image of a map.
Exhibitors : This page, like the sectionals page has a table set up to display the list of exhibitors once they are available. Exhibitors will have their company’s website linked on this page if they choose to submit that information to the CWE. There is also a link to the 2010 Exhibitor Application on this page in pdf format.
Contact Us : I implemented a SPRY Validation contact form into this page. The form allows visitors to quickly ask the CWE a question. The name and email fields have validation applied to them, the rest of the fields are optional.
In additional to what I described above I created a new logo for the CWE using what they had and changing the colors and defining the shapes a bit better.
I also created and installed a Favicon for their site, who wants the default bland site icon right!
I also had to set up a new hosting account and domain name. The CWE went with my suggestion that I wrote in my scope document to change their domain name to www.cweconvention.org from www.dwave.net/~cwe.
I was able to save them a bit of money on the web hosting as well as I came across a 25% off coupon for GoDaddy on the web. In the future when I am working strictly for profit this will be a savings for me as I saved about $20 from the price I quoted for 2 years of hosting in the scope document.
I also created 3 email accounts for the domain. The first is chair@cweconvention.org and has all messages forwarded to the current chair’s email. I have the messages forwarded so the chair does not need to log into the GoDaddy account to check for messages. The other two email accounts; webmaster@cweconvention.org and info@cweconvention.org are set up and in use as well. The webmaster email account is set up to forward all incoming messages to me and the info email account is used with the Contact Form and is also forwarded to the current CWE chair person.
Other than content updates I need to validate all of my pages for XHTML, CSS, and Accessibility which I hope to get finished up next week.
